These Terms outline your rights and responsibilities when using the WhoCan app. Please read them carefully to ensure a smooth, secure experience.
Introduction
Welcome to WhoCan! By creating an account and using the WhoCan app, you agree to these Terms and Conditions. This agreement is between you and WhoCan (“the Company”) and governs your access to and use of the services available through our platform.
User Accounts
Registration Requirements
All users must provide accurate, complete, and current information when signing up. This helps ensure trust between users and supports safe transactions and communication.
Account Security
You are responsible for keeping your account credentials confidential. Any activity under your account is your responsibility. Please notify us immediately if you notice any unauthorized use.
Services Offered
Platform Functionality
WhoCan is an app-based platform that connects people seeking services (“Requesters”) and those offering them (“Providers”). The app facilitates the booking of home and lifestyle services daily — it provides the tools to enable transactions with a simple and convenient process.
Job Completion Management
Requesters can post services to list, negotiate, schedule services, and rate providers. All parties are expected to engage safely on the platform.
Requirements for Providers
To receive payments for services rendered, all Providers must set up and connect a valid Stripe account through the WhoCan platform. This step is required to ensure accurate, direct payouts and compliance with financial regulations. Without linking to Stripe, Providers will not be eligible to accept payments through the app.
User Conduct
Compliance
Users are expected to follow all applicable laws when using WhoCan.
Prohibited Use
Any behavior involving fraud, abuse, harassment, or illegal activities is not allowed. Such actions may result in the suspension or termination of your account.
Payments and Refunds
Service Fees
WhoCan applies a platform service fee from each transaction. All payments are processed through Stripe, and users are subject to its terms and conditions.
Cancellations
- Requesters may cancel services through the app. (Refunds are available if cancellations happen with sufficient notice.)
- Late or contradictory cancellations are to be compensated by the Provider.
- If a service cancels or fails to show up without valid reason, the Requester will receive a full refund, and the Provider may be removed from the platform.
Refund Requests
Providers who cancel repeated appointments without justification may be suspended or permanently removed from the platform. If customer support determines that a client deserves a refund, it will be processed back to the user’s Stripe account, unless the payment request was fraudulent, invalid, or ineligible.
Frequent Requester Cancellations
Requesters who cancel multiple bookings within a short timeframe may face temporary restrictions on new service requests.
Unaccepted or Missed Appointments
If Providers repeatedly miss or reject the agreed expectations, Requesters can submit a complaint to customer support to dispute either partial or full refunds. Users must report an issue in a partial or full claim within 3 business days of the service time.
Dispute Resolution
Refunds and cancellations are reviewed via WhoCan’s amicable resolution. If that fails, our support team will mediate based on the evidence available.
Processing Time
All refunds will be processed within a standard time frame and then refunded to the original payment method. Time may vary depending on your payment provider and refund type.
Limitation of Liability
Nature of WhoCan
WhoCan is merely a platform that connects users. We are not responsible for the services promised or requested. All responsibility lies with the individual users who enter service agreements.
Service Risks
WhoCan shall not be liable for injuries, damages, or losses that occur during service interactions. Users are encouraged to exercise caution when receiving services.
Data Breaches
We prioritize the security of your data, but no system is entirely immune from breaches. If a breach occurs, we will take appropriate action to notify impacted individuals and affected users as required.
Legal Cooperation
We may disclose user information to law enforcement if legally required. This is necessary to uphold the law and protect the integrity of our platform.
Intellectual Property
All app content, including software, graphics, and design, is the property of WhoCan or its licensors. You may not reuse or repurpose any part of the app without written permission.
Account Suspension and Termination
WhoCan reserves the right to suspend or permanently deactivate any account that violates these terms, engages in harmful conduct, or disrupts the app experience for others.
Updates to Terms
These Terms and Conditions may be updated from time to time. Users will be notified of changes within the app. Continued use of WhoCan after updates indicates your acceptance of the updated terms.
Governing Law
These terms are governed by the laws of the State of Maryland, United States. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in that region.
